Do I Have to Leave Something to My Spouse and Each Child?

We are regularly asked, “Do I have to leave something to my spouse and each child?”

The answer is that, no, you do not have to.

You can choose to leave part of your estate to some of your children, but not others. Or you can choose to leave all of it to your children with nothing left to your spouse.

Each person has total discretion in choosing his or her heirs. The entire estate can be left to any person or group of persons desired. It could also be left to the charities supported by the person making the Will.

So, again, there is no legal requirement that a portion of your estate must be left to your spouse or you children. It’s all up to you.
